Abstract

Judicially, there are types of settling a dispute case: by litigation in the court and by non-litigation outside of the court. In non-litigation as an alternative settling. In Aceh Besar, a dispute is dominantly settled through Majelis Adat (Adat Council) like a problem of inheritance because the people think that it is in accordance with the people’s sense of justice which is more effective. It is, therefore, interesting to analyze is how far the effectiveness of settling a dispute in inheritance the Majelis Adat is. It was located in Darussalam Subdistrict. The result of the research showed that the legal ground for Majelis Adat Aceh Besar in settling dispute in inheritance by handing down the Verdict No. 40/1999 on Organization of Aceh Special Region in which Aceh and Law No. 11/2006 on Aceh Provincial Government. The role of Majelis Adat Aceh Besar in settling dispute in inheritance is a mediator and as a communicator. The implementation of the ruling of the Majelis Adat Aceh Besar in settling dispute in inheritance for the conflicting parties was effective since it is carried out by the stakeholders so that it can be settled by adat (custom) without any conflict in the future. Abstract

Legal act on land and building rights acquisition must have AJB made by and before PPAT who has the authority to organize land and building transact. Based on Article 91, paragraphs 1 and 3 of Law on PDRD, a PPAT can only sign Transact Certificate after a taxpayer submits the evidence of tax payment. Otherwise, a sanction will be imposed upon him, based on Article 93, paragraphs 1 and 3 juncto Article 11, paragraphs 1 and 3 of Perda  of Samosir Regency Number. 9/2011 on BPHTB. PPAT has to be liable for supervising BPHTB tax payment. the sanction when he fails to do his job in supervising of BPHTB tax payment in Samosir Regency varies. Abstract

The implementation of the trade in the certified land title between the seller and the buyer can be done by making a PJB (Sale/Purchase Binding Agreement) on the land title. The research used judicial normative and descriptive analytic method. The research result shows that legal domicile of paying off certificate made before a Notary has authentic evidence for the buyer who has paid off the whole price of the certified land to the seller in a sale/purchase binding agreement on the certified land underhandedly. Abstract

In its implementation, credit contract with fiduciary collateral, certificate of fiduciary collateral made by a Notary and registered electronically by the Notary. A creditor only holds it and other documents which are related to the collateral as security when there is something occurs in its implementation. The research used judicial normative and descriptive analytic method. The result of the research showed that the binding of fiduciary collateral in a banking credit contract is preceded by a feasibility study, administration and collateral, fiduciary certificate made by Notary, and its registration electronically, and the signing of insurance polis. A debtor who gives fiduciary collateral has to be liable for the Bank as the creditor upon the disappearance of fiduciary collateral. Abstract

There are many cases related to notarial deeds claimed by third parties because one of them defaults or offends the law; causing the notary to be blamed for the material fault. As written evidence, what is stated in a notarial deed has to be acknowledged. A notary does not guarantee what is stated by persons appearing is true because he/she is not the investigator of the data handed by the parties involved. The problems of the research are how the criteria of a notarial act and the legal consequence are toward an authentic deed which has material error, how the responsibility of a notary and the legal protection to him/her are in case there is a material error in the deed he/she has made, and how the consideration of Medan District Court and the legal consequence of the material error in a notarial deed are regarding the Verdict No.635/Pdt.G/2013/PN.Mdn. Abstract

Road construction agreement between PT. Mutiara Aceh Lestari with Dinas Bina Marga dan Cipta Karya Aceh, arising due to natural disasters, landslides in December 2010. This type thesis research using normative juridical research, by examining the statutory provisions and regulations in the procurement of goods / services, Legal No. 18 OF 1999 President No. 4 of 2015, and Government Regulation No. 21 Year 2008. From the research, carried out in their execution of work before the contract was made because of a natural disaster is not contrary to law. The agreement form of default in road construction between PT. The default form in the contract of road construction among PT. Mutiara Aceh Lestari and Dinas Bina Marga and Cipta Karya was in which the debtor had good performance, yet it was not in accordance with or committed an errorAceh province District Court Consideration No. 46 / Pdt. G / 2013 / PN-BNA was granted as part of a lawsuit of PT. Mutiara Aceh Lestari because the identity is not clear from the PT. Mutiara Aceh Lestari, precisely because of the PT. Mutiara Aceh Lestari does not violate the Law No. 40 of 2004

Abstract

Mudharabah financing is a mandate and trust financing. It is not allowed to ask for collateral to the managers because it is merely the capital manager. The problems of the research were how about the implementation of mudharabah financing in Bank Syariah Mandiri, Lhoksemawe Branch Office in accordance with the Islamic Law, how about the implementation of collateral in the mudharabah financing in Bank Syariah Mandiri, Lhoksemawe Branch Office according to the Islamic Law, and how about the role of a notary related to the collateral binding in the mudharabah financing by Bank Syariah Mandiri, Lhoksemawe Branch Office. In order to give answers to these problems, the research used empirical judicial approach with qualitative descriptive method which analyzed the primary, secondary, and tertiary data, and conducted interviews. The result of the research shows that is, Mudharabah financing is principally done without any collateral from the customers, however, in practice, the Bank still request for collateral from the fund manager in order to prevent any deviance by the manager so that it reduces the risk over the payment. The implementation of the collateral in practice is based on two grounds, namely to secure stockholders’ trust on the agency and the society’s situation and condition today which have been altered in regard of commitment to the noble values, such as trust and honesty. Abstract

The research problems are how about the process of the implementation of contracted work contract in recording electric meter between PT. PLN (PERSERO) Sigli branch, and PT. Multi Guna Putra Aceh Mandiri and how about the settlement and the liability of the party that breaches the contract (default). The research used judicial normative and descriptive analytic methods which described, analyzed, and explained the legal provisions in theory and practice obtained from field study. The result of the research showed that PT. PLN (PERSERO) has breached the contract (default) to PT. Multi Guna Putra Aceh Mandiri because up to now PT. PLN (PERSERO) Sigli branch has not paid off the fee to PT. Multi Guna Putra Aceh Mandiri although the contracted work in recording electric meter is in accordance with the contract signed by both parties. Keywords: Contract in Recording Electric Meter

Abstract

Agreement is one of the requirements for a contract. The use of e-mail as the media for an agreement has the impact on the international society in general and the Indonesia people in particular. For the Indonesian people, this is related to an important legal problem either it is viewed from it’s validity according to the prevailing legal provisions in Indonesia or from the settlement of the dispute which is caused by the agreement through e-mail. The objective of the research was to find out the validity of a contract through e-mail, the use of digital signature, and how about the settlement of dispute caused by a contract through email. The research used judicial normative method and it’s specification was done by using descriptive analytic approach. The source and the type of the data were secondary data. Abstract

Transfer on farm land rights which is caused by a legal action (legal act) in the form of hibah (grant) written in a certificate and stamped with seal in 1935 before the adat and religious leaders in the adat meeting and was agreed by all heirs has met the requirement determined by the Minangkabau customary law. The research used judicial normative method which was aimed to study legal provisions, norms which were referred to regulations, legal principles, and court’s verdicts relating to the force of legal evidence of the hibah certificate. The result of the research shows that the legal force of the evidence on the hibah certificate, relating to the Supreme Court’s Ruling No. 2771 K/PDT/2010, is stated as the initial written evidence. It means that the hibah certificate is valid as written evidence which also means that it is valid as an underhanded deed which has met formal requirement for a legal act Keywords: Evidence, Hibah Certificate, Land Rights Transfer
